The agreement governing your use of the Apana Medical platform.

These General Terms & Conditions (hereinafter referred to as the "Terms") constitute a legally binding agreement between you and Apanamedical (hereinafter referred to as "Apanamedical", "Company", "We", "Us", or "Our") governing your access to and use of the Apanamedical website, mobile application, online pharmacy platform, and all related services offered through the Platform.

By accessing, browsing, registering, purchasing, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and all applicable policies. If you do not agree to these Terms, you must not use the Platform.

Apanamedical reserves the right to amend, modify, update, or replace these Terms at any time without prior notice. Continued use of the Platform after such modifications shall constitute acceptance of the revised Terms.

I. Defined Terms

  • Apanamedical: Refers to Apanamedical, its subsidiaries, affiliates, partners, successors, assigns, employees, and authorized representatives.
  • Platform: The Apanamedical website, mobile application, software, and related services.
  • User / Customer / You: Any individual, patient, caregiver, visitor, purchaser, or entity accessing or using the Platform.
  • Order: Any request placed through the Platform for medicines, healthcare products, diagnostics, consultations, or related services.
  • Prescription Medicine: Medicines that require a valid prescription from a registered medical practitioner.
  • OTC Products: Over-the-counter medicines, healthcare products, wellness products, supplements, personal care products, and medical devices that do not require a prescription.
  • Confidential Information: Any non-public information relating to Apanamedical, its business operations, healthcare partners, customers, suppliers, and services.

II. Services

Apanamedical may provide the following services:

  • Online sale of medicines and pharmaceutical products
  • Sale of prescription medicines subject to verification
  • Sale of OTC medicines and healthcare products
  • Medicine home delivery services
  • Prescription upload and verification services
  • Diagnostic and laboratory booking services
  • Health and wellness products
  • Teleconsultation facilitation services
  • Health-related informational services
  • Promotional campaigns and loyalty programs
  • Any additional services introduced by Apanamedical from time to time

All services are subject to availability and applicable laws.

III. Eligibility

You represent and warrant that you are at least 18 years of age, you are legally competent to enter into a binding agreement, all information submitted by you is accurate and complete, and any prescription uploaded is genuine and lawfully obtained. Minors may use the Platform only under the supervision of a parent or legal guardian.

IV. User Registration

To access certain services, Users may be required to create an account. You agree to provide accurate registration details, maintain and promptly update account information, keep login credentials confidential, and accept responsibility for all activities occurring under your account. Apanamedical reserves the right to suspend or terminate accounts containing false, misleading, or incomplete information.

V. Prescription Verification

Certain medicines require a valid prescription issued by a registered medical practitioner. Apanamedical reserves the right to verify prescriptions before dispensing medicines, reject illegible, expired, altered, forged, or suspicious prescriptions, request additional information from Users, and refuse delivery where legal requirements are not satisfied. Submission of a prescription does not guarantee order acceptance.

VI. Pricing and Payments

All prices displayed on the Platform are subject to change without notice. Payment methods may include Credit Cards, Debit Cards, UPI, Net Banking, Digital Wallets, and Cash on Delivery (where available). Users agree to pay all applicable charges, taxes, delivery fees, and statutory levies.

VII. Refund and Return Policy

Due to health and safety regulations, medicines and healthcare products are generally non-returnable and non-refundable after delivery. Refunds may be considered only in circumstances such as wrong product delivered, damaged product delivered, expired product delivered, product unavailable after payment, or duplicate payment. Approved refunds shall be processed within a reasonable timeframe.

VIII. Cancellation Policy

Orders may be cancelled prior to dispatch. Apanamedical reserves the right to cancel orders due to product unavailability, invalid prescriptions, pricing errors, regulatory restrictions, fraud prevention measures, or incomplete information. Refunds for eligible cancellations shall be processed according to the Refund Policy.

IX. Delivery Services

Delivery timelines are estimates and may vary due to weather conditions, traffic disruptions, government restrictions, regulatory requirements, or third-party logistics delays. Users are responsible for providing accurate delivery information.

X. Security

Transactions conducted on the Platform are processed through secure payment gateways. Apanamedical does not store sensitive card details. Users must immediately notify Apanamedical regarding unauthorized account access, security breaches, or fraudulent transactions.

XI. User Obligations

Users agree to provide accurate information, use medicines responsibly, follow medical advice and dosage instructions, comply with applicable laws, maintain account confidentiality, and refrain from fraudulent activities. Users remain solely responsible for their healthcare decisions.

XII. Prohibited Activities

Users shall not upload forged prescriptions, purchase medicines for unlawful purposes, resell medicines without authorization, impersonate others, introduce malware or malicious software, interfere with Platform operations, or violate healthcare or pharmaceutical laws. Violation may result in suspension, termination, blacklisting, and legal action.

XIII. Intellectual Property Rights

All content, software, trademarks, logos, graphics, text, and intellectual property on the Platform remain the exclusive property of Apanamedical or its licensors. Users receive a limited, non-exclusive, revocable license solely for personal use of the Platform.

XIV. Privacy Policy

User information, medical records, prescriptions, and personal information shall be collected, processed, stored, and used in accordance with the Apanamedical Privacy Policy and applicable laws.

XV. Third-Party Services

The Platform may facilitate access to diagnostic laboratories, healthcare professionals, telemedicine providers, logistics providers, and payment service providers. Apanamedical does not guarantee or assume responsibility for third-party services.

XVI. Suspension and Termination

Apanamedical may suspend or terminate access without prior notice where these Terms are violated, fraud is suspected, regulatory requirements necessitate such action, or user conduct is harmful to Apanamedical or others.

XVII. Medical Disclaimer

Apanamedical does not provide medical advice. Information available on the Platform is provided solely for informational purposes and shall not be considered medical advice, diagnosis, treatment recommendation, or professional healthcare consultation. Users should always consult qualified healthcare professionals before taking any medicine or healthcare product.

XVIII. Product Information Disclaimer

Product descriptions, medicine information, health content, and wellness information are provided by manufacturers, suppliers, and publicly available sources. Apanamedical does not warrant the completeness, accuracy, or suitability of such information.

XIX. Diagnostic Services Disclaimer

Diagnostic and laboratory services are provided by independent third-party providers. Apanamedical does not guarantee test accuracy, report interpretation, laboratory performance, or medical outcomes. Users should consult healthcare professionals regarding test results.

XX. Teleconsultation Disclaimer

Apanamedical may facilitate consultations with independent healthcare professionals. Medical advice, diagnosis, prescriptions, and treatment recommendations are solely the responsibility of the consulting healthcare professional. Apanamedical shall not be liable for consultation outcomes.

XXI. Limitation of Liability

To the maximum extent permitted by law, Apanamedical shall not be liable for indirect or consequential losses, medical complications, adverse drug reactions, loss of profits, data loss, or service interruptions. The total liability of Apanamedical shall not exceed the amount paid by the User for the relevant order.

XXII. Indemnity

Users agree to indemnify and hold harmless Apanamedical, its directors, employees, affiliates, agents, and partners against claims arising from misuse of medicines, false information, invalid prescriptions, violation of law, or breach of these Terms.

XXIII. Force Majeure

Apanamedical shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, pandemics, strikes, governmental actions, internet failures, or emergencies.

XXIV. Notice and Grievance Redressal

Any complaints, disputes, adverse event reports, product concerns, or grievances may be submitted through Apanamedical customer support or the designated Grievance Officer.

XXV. Entire Agreement

These Terms, together with the Privacy Policy and other applicable policies, constitute the entire agreement between the User and Apanamedical.

XXVI. Governing Law and Jurisdiction

These Terms shall be governed by the laws of India. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

XXVII. Acceptance of Terms

By registering, accessing, browsing, placing orders, uploading prescriptions, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and Conditions.
